Terms of Service
These Terms of Service (“Terms”) are a contract between you and Eternal Dream Inc (“Eternal Dream”, “we”, “us”). They govern your use of eternaldream.io, our planning tools, our assistants and any order you place through the marketplace. By creating an account or using the service you agree to them. Funeral homes that list on the marketplace are additionally bound by the Marketplace Provider Agreement.

AI tools are helpers, not advisors
The planning assistant and chatbot can be wrong. They are not legal, financial, tax or medical advice.
Disputes with us go to arbitration
After trying to resolve things informally, disputes with Eternal Dream are decided by individual arbitration. You can opt out within 30 days of accepting.

1.Who we are and who may use the service
The service is operated by Eternal Dream Inc. It is offered to residents of the United States who are at least 18 years old. If you use the service for a family member or estate, you confirm that you are authorized to act for them.

2.What Eternal Dream is, and is not
Eternal Dream is an online marketplace. We list independent funeral homes, show their services and prices, let you compare them, message them, and place and pay for orders. We also publish educational content and offer automated planning assistants.
We are not a funeral provider. We do not perform, supervise or guarantee any funeral, cremation, transport, embalming or memorial service. Each funeral home on the marketplace is an independent business licensed by its state, and your agreement for the services is with that funeral home. Eternal Dream is not a party to that agreement.
“Verified” has a specific meaning. A funeral home is shown as verified when our team has confirmed its establishment license against the state licensing board and the check is re-run automatically each week. Verification means the license was current when we checked. It is not an endorsement, a guarantee of quality, or a guarantee that a license remains valid at the moment you book. Always confirm details that matter to you directly with the funeral home.
3.Your account
- Give accurate, current information and keep it updated.
- Keep your password private. You are responsible for activity under your account and must tell us promptly about any unauthorized use.
- One person, one account. Do not create accounts for others without authority.
- We may verify your identity before acting on an order, a refund request or a privacy request.
4.Orders, prices and payment
Prices come from the funeral home. Each funeral home publishes its own prices, including its General Price List as required by the FTC Funeral Rule (16 C.F.R. Part 453). Where a funeral home has confirmed a price we mark it as provider-confirmed. Where we show a regional estimate instead, it is labeled as an estimate and is not that funeral home’s quote. The price you pay is the price the funeral home has set at the time you place the order.
The marketplace fee. When you place an order, Eternal Dream adds a marketplace fee of 12% of the funeral home’s subtotal. The fee, applicable taxes and the total are shown on the checkout page before you confirm payment. The fee pays for the marketplace: verification, comparison tools, messaging, secure payment and support.
How payment works. Payment is processed by Stripe. Eternal Dream collects the total on behalf of the funeral home as its limited payment collection agent and transfers the funeral home’s subtotal and tax to the funeral home’s connected account. Your payment to us discharges your payment obligation to the funeral home for that amount. We never see or store your full card number.
Order confirmation. An order is placed when you confirm payment. The funeral home then contacts you through the platform to coordinate the arrangement. Details of the arrangement (dates, selections, required documents) are agreed between you and the funeral home.
5.Cancellations, refunds and service issues are handled with the funeral home
Each funeral home sets its own cancellation and refund terms, which you should confirm with it before services begin. To cancel or request a refund, contact the funeral home through the platform’s messaging inbox or by the contact details it provides after booking. If the funeral home approves a refund, it can instruct us to process the refund to your original payment method, and we will do so as its payment agent.
The marketplace fee compensates Eternal Dream for the marketplace and is not refundable, except that we refund it in full if the funeral home cancels an order before any service has been performed or if we cancel the order ourselves.
We are not liable for the acts or omissions of any funeral home, including delays, quality of service, or a funeral home’s decision on a cancellation or refund. We may, at our discretion, help you and the funeral home communicate, but we do not decide the outcome. Before disputing a charge with your card issuer, please contact the funeral home and then us; a card dispute on an order the funeral home has already fulfilled may result in the funeral home pursuing the amount from you directly.
6.Pre-planning and pre-need contracts
Our pre-planning tools help you record your wishes, compare funeral homes and share your plan with your family. Eternal Dream does not sell pre-need (pre-paid) funeral contracts and does not guarantee any price for a future service. Pre-need contracts are regulated by state law and may only be sold by licensed providers under their own contracts, which are separate from these Terms. Any price protection is provided, if at all, by the funeral home under such a contract.
7.Reviews and other content you provide
You keep ownership of reviews, messages, photos, articles and other content you submit. You give Eternal Dream a worldwide, non-exclusive, royalty-free license to host, display, reproduce and distribute that content on the service and in our marketing of the service, including in machine-readable formats read by search engines and automated assistants, for as long as it is published. You may delete content you posted at any time, subject to copies kept for legal reasons.
Reviews must be honest. Only people who booked through the platform may review the funeral home they used. Do not post a review you were paid or otherwise incentivized to write, a review of a business you are connected to, or a review that is not based on your own experience. We follow the FTC’s Consumer Reviews and Testimonials Rule (16 C.F.R. Part 465): we do not suppress reviews because they are negative, and we remove reviews that are fake, incentivized or off-topic. Funeral homes may respond to reviews but may not offer anything for their removal.
Articles submitted for the blog are reviewed before publication and may be edited for clarity. By submitting, you confirm you wrote the piece or have the right to license it.
8.Copyright complaints
If you believe content on the service infringes your copyright, send a notice to support@eternaldream.io with “Copyright notice” in the subject, identifying the work, the material you want removed and its location, your contact details, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that the notice is accurate and that you are the owner or authorized to act for the owner, and your physical or electronic signature. We remove or disable infringing material, notify the person who posted it, accept counter-notices, and terminate the accounts of repeat infringers.
9.Automated assistants and AI features
The chatbot, the planning assistant and the obituary builder generate text with large language models. They can be wrong, incomplete or out of date. They do not provide legal, financial, tax, insurance, medical or funeral-directing advice, and nothing they produce creates a professional relationship. Verify anything important with the funeral home or a qualified professional.
You own the obituaries and plans generated for you. Do not enter Social Security numbers, card numbers or other people’s sensitive information into the assistants; the checkout form is the place for arrangement details.
Third-party AI assistants (for example ChatGPT or Claude) may read our public listings and may submit a consultation request to a funeral home on your behalf. Such a request is created only after the assistant confirms your identity and intent with you, and it is a request, not a confirmed appointment or an order.
10.Acceptable use
- Do not use the service for anything unlawful, or to harass, defame or deceive anyone.
- Do not impersonate a person, a funeral home or Eternal Dream.
- Do not scrape, harvest or bulk-download data, or access the service with automated tools except public search and AI crawlers reading pages we make available for that purpose.
- Do not interfere with the service, probe its security, or use another person’s account.
- Do not contact funeral homes through the service to sell them something.
11.Funeral home providers
Funeral homes that list on the marketplace agree to the Marketplace Provider Agreement, which covers licensing warranties, fees and payouts, the Founding Partner Program, handling of family information, reviews, and termination. Where that agreement conflicts with these Terms for a provider, the Provider Agreement controls.
12.Privacy
How we collect, use and share personal information is described in the Privacy Policy. You can control analytics, advertising and session recordings on the Privacy choices page.
13.Our intellectual property
The service, its software, design, text, graphics and trademarks belong to Eternal Dream or its licensors. You may use the service for its intended purpose and may not copy, modify, sell or reverse-engineer it. Funeral home names, logos and price lists belong to the funeral homes.
14.Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, ETERNAL DREAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ABOUT THE ACCURACY OF PRICES OR LISTINGS, THE AVAILABILITY OF THE SERVICE, THE OUTPUT OF AUTOMATED ASSISTANTS, OR THE CONDUCT, LICENSURE OR SERVICES OF ANY FUNERAL HOME.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
15.Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ETERNAL DREAM AND ITS OWNERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR ANY FUNERAL HOME’S SERVICES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE MARKETPLACE FEES YOU PAID TO ETERNAL DREAM IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limits do not apply to liability that cannot be limited by law, including liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by our negligence, and they do not limit any non-waivable consumer right. Some jurisdictions do not allow limits on certain damages, so some of the above may not apply to you.
16.Indemnification
You will defend and indemnify Eternal Dream against claims, losses and reasonable legal costs arising from your breach of these Terms, content you submit, or your misuse of the service, except to the extent caused by our own negligence or breach.
17.Resolving disputes with Eternal Dream
This section covers disputes between you and Eternal Dream. It does not cover disputes with a funeral home, which are governed by your agreement with that funeral home.
Talk to us first. Before starting any formal proceeding, send a written description of the dispute to support@eternaldream.io. We will do the same. If we have not resolved it within 30 days, either of us may proceed as set out below.
Binding arbitration. Any dispute that is not resolved informally will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, rather than in court. The Federal Arbitration Act governs this section. The arbitrator can award the same relief a court could award to you individually. Hearings may be held by video or, if in person, in your county of residence.
Exceptions. Either of us may bring an individual claim in small-claims court, and either of us may seek an injunction in court to protect intellectual property or to stop unauthorized use of the service.
Your right to opt out. You may opt out of arbitration by emailing support@eternaldream.io with “Arbitration opt-out” and your account email within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
No class actions. Disputes are resolved individually. Neither of us may bring or participate in a class, collective or representative proceeding, and the arbitrator may not consolidate claims of different people. If this paragraph is found unenforceable for a particular claim, that claim will proceed in court and not in arbitration.
Coordinated filings. If 25 or more similar demands are filed by or with the help of the same law firm, they will be resolved in staged batches of up to 25, with fees paid per batch, and statutes of limitation are tolled while demands wait their turn.
Jury waiver. To the extent a dispute proceeds in court, both of us waive a jury trial where the law allows.
18.Governing law and venue
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to the arbitration section, courts located in the State of Florida have exclusive jurisdiction, and you consent to their personal jurisdiction. Nothing in this section takes away consumer protections of the state where you live.
Notice to California residents. Under California Civil Code §1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. Our contact details are in the last section of these Terms.
19.Ending your account
You may close your account at any time by contacting us. We may suspend or close your account if you breach these Terms, if required by law, or if the account has been inactive for more than 24 months; where practical we will give you notice and a chance to respond. Orders already placed continue to be governed by these Terms and your agreement with the funeral home.
Sections on payment, content licenses, disclaimers, liability, indemnity, disputes and governing law survive termination.
20.Changes to these Terms
We may update these Terms. For material changes we will email account holders and post a notice on the service at least 30 days before the change takes effect, and we will update the version and effective date at the top of this page. Using the service after the effective date means you accept the updated Terms. If you do not agree, close your account before that date. The change history at the end of this page lists every version.
21.General terms
- These Terms, the Privacy Policy, the Cookie Policy and, for funeral homes, the Provider Agreement are the entire agreement between you and Eternal Dream about the service.
- If any provision is unenforceable, the rest remains in effect.
- Our not enforcing a provision is not a waiver of it.
- You may not assign these Terms. We may assign them to a successor of our business, and will notify you.
- Neither of us is liable for delays caused by events beyond reasonable control, such as natural disasters, outages of third-party providers or government action.
- You agree to receive notices from us electronically at the email on your account.
- We aim to meet WCAG 2.1 AA accessibility standards. If you have difficulty using any part of the service, contact us and we will help you complete what you need.
